Mary Lay ASCLS-Idaho
Government Affairs Chair
August 2007
Linda Comeaux was our keynote speaker at 2007 Spring Convention. Her speech focused on the Medicare Clinical Laboratory Competitive Bidding Demonstration mandated by Section 302 (b) of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003. We discussed the negative impact this would have on laboratories. The most recent news out of Washington, DC is very encouraging. Congressman Nydia Velazquez (D-New York), who sits on the House Small Business Committee, has introduced legislation to repeal the Medicare competitive bidding demonstration project for Clinical Laboratory Services. I have read a copy of the rough draft of the bill. Ranking Member Steve Chabot's (R-OH) office has shown interest in Co-Sponsorship; ASCLS National is still awaiting the final word. However, Chairwoman Velazquez plans to go ahead with the bill in the event Mr. Chabot chooses not to co-sponsor it. Letters of support for this bill were requested so she could note the organizations supporting the legislation in her opening statement. Clinical Laboratory Chemists plan to spend the August recess contacting all Members of Congress to co-sponsor this legislation. In addition, Representative John D. Dingell, Chairman of the Committee on Energy and Commerce, has written a letter to Michael O. Leavitt, Secretary of the US Department of Health and Human Services, asking nine questions regarding the project. I have copies of all the detailed letters if anyone desires further information.
I will update the Board as to the progress of Competitive Bidding.
